Garage Conversion: Planning Permission or Building Regulations?

A garage conversion can be one of the simplest ways to create additional living space without increasing the overall footprint of your home. But one of the first questions homeowners usually ask is: do I need planning permission?

The answer is not always straightforward. Many garage conversions can be carried out without a full planning application, but that does not mean the work is exempt from Building Regulations. The two systems serve different purposes and need to be considered separately.

In this guide, we explain when planning permission may be required for a garage conversion, when permitted development may apply, and the Building Regulations issues that should be considered before construction begins.

Do You Need Planning Permission for a Garage Conversion?

In many cases, converting an integral garage into living accommodation does not require planning permission, provided the work is mainly internal and the conversion does not involve enlarging the building.

However, this should not simply be assumed. Planning permission may be required depending on the alterations proposed, the type of property and any planning restrictions that apply to the site.

Particular care is needed where permitted development rights have been removed by a condition attached to an earlier planning permission, where an Article 4 Direction applies, or where the property is in an area subject to additional planning controls. Properties in conservation areas and other designated locations may also be subject to additional controls, while permitted development rights generally available to houses do not apply in the same way to flats and maisonettes.

Do Garage Conversions Need Building Regulations Approval?

This is because Building Regulations deal with the technical performance and safety of the completed work rather than whether the development is acceptable in planning terms.

A typical garage was not originally designed to provide the same internal environment as a bedroom, study, playroom or other habitable space. The conversion therefore needs to address several technical matters before the space can be considered suitable for its new use.

Depending on the existing construction and the proposed layout, these can include thermal insulation, damp protection, ventilation, fire safety, structural alterations, drainage, electrical work and the adequacy of the existing floor, walls and roof.

This is where proper Building Regulations drawings and construction details become important. They establish how the existing garage will be upgraded and how new elements should be constructed to satisfy the relevant requirements.

What Building Regulations Apply to a Garage Conversion?

The exact requirements depend on the existing garage construction and the proposed use of the converted space. However, the following are some of the principal technical matters that normally need to be considered.

Insulation & Thermal Performance

Garages are often constructed with significantly lower levels of thermal insulation than the main dwelling. External walls, the roof and, where applicable, the floor may therefore need to be upgraded as part of the conversion.

The required construction will depend on what already exists. For example, an existing cavity wall may be capable of being upgraded differently from a single-skin masonry garage wall. The proposed build-up needs to provide appropriate thermal performance while also considering condensation risk, moisture control and available internal space.

Where the former garage door opening is infilled, the new wall should also be designed to achieve the required thermal performance and integrate properly with the existing construction.

Existing Garage Floor

The existing garage floor should not automatically be assumed to be suitable for habitable accommodation. Its construction, level, damp protection and thermal performance need to be established before deciding how it should be upgraded.

Depending on the existing slab, the solution may involve a new damp-proof membrane, insulation and a new floor finish or screed. Floor levels also need careful consideration, particularly where the garage floor sits below the floor level of the adjoining house.

The junction between the upgraded floor, existing walls and new infill construction is particularly important because poorly resolved junctions can create cold bridging or moisture problems.

Damp Protection

Garages are not always constructed with the same level of damp protection expected within habitable accommodation. Before conversion, the existing walls and floor should therefore be assessed for evidence of moisture and to establish the existing damp-proof course and damp-proof membrane arrangements.

Where a new damp-proof membrane is required to the floor, it should be appropriately linked with the damp-proof course or other damp-resistant construction at the perimeter. Particular attention is needed around the former garage-door opening, where new wall construction meets the existing building.

Any existing damp or water ingress should be investigated and addressed before insulation and internal finishes are installed rather than simply being concealed by the new construction.

Ventilation

Once a garage becomes habitable accommodation, adequate ventilation needs to be provided to maintain indoor air quality and help control condensation and moisture.

The ventilation strategy will depend on how the converted space will be used. Background ventilation may be required through suitable trickle ventilators, together with appropriate provision for purge ventilation through openable windows or doors.

If the conversion includes a bathroom, shower room, utility area or other moisture-producing space, mechanical extract ventilation may also be required. The extract system should discharge to the outside rather than into a roof void or other enclosed part of the building.

Ventilation should be considered alongside insulation and airtightness. Improving the thermal performance and airtightness of the former garage without providing suitable ventilation can increase the risk of condensation and poor indoor air quality.

Fire Safety

Converting a garage into habitable accommodation can affect the fire-safety arrangements of the dwelling. The proposed layout should therefore be considered as part of the house as a whole, particularly in relation to escape routes, doors, windows and the detection and warning system.

Where the converted garage provides a new habitable room, suitable means of escape will need to be maintained. Depending on the layout and storey level, this may include an appropriate escape window or direct access to a suitable escape route.

Fire detection and alarm provision should also be reviewed as part of the conversion. Where new or altered alarms are required, their type, location, interconnection and power supply should comply with the relevant Building Regulations requirements.

Additional fire-resisting construction may be necessary in particular circumstances, for example where the garage is only partially converted and habitable accommodation remains adjacent to an area still used for parking or storage.

Structural Alterations

Garage conversions often appear structurally straightforward, but alterations to the existing building should still be assessed carefully. Removing walls, widening openings or introducing new openings can affect the way loads are supported and transferred through the structure.

Where a structural wall is altered or removed, a suitable beam, lintel or other structural support may be required. Structural calculations will normally need to be prepared by a structural engineer where significant load-bearing alterations are proposed.

The former garage-door opening also requires consideration. The new infill wall needs adequate support, and the suitability of the existing foundation should not simply be assumed. Depending on the existing construction and ground conditions, a new foundation or other suitable structural solution may be required.

The architectural and structural information should be coordinated so that beam positions, bearings, foundations and construction details are consistent across the Building Regulations drawing package.

Drainage

Drainage may need to be considered where the garage conversion introduces new sanitary accommodation, such as a WC, shower room, utility room or kitchen area.

New appliances should be connected to a suitable drainage system with appropriate pipe sizes, gradients, traps and ventilation. The position and depth of existing drains should be established where they affect the proposed layout, rather than assuming that a convenient connection is available.

Particular care may also be required where new drainage passes through or beneath existing foundations and floor construction. Any new below-ground drainage should be coordinated with the proposed floor build-up and other structural work.

Where alterations affect existing surface-water drainage, such as rainwater pipes or gullies associated with the garage, these should also be incorporated into the overall drainage strategy.

Electrical Work

A garage conversion will normally involve alterations or additions to the electrical installation, including lighting, socket outlets and potentially heating, ventilation or other fixed equipment.

Electrical work should be designed and installed in accordance with the applicable electrical safety requirements. Certain electrical work in dwellings is also subject to Part P of the Building Regulations and should be undertaken and certified through an appropriate route.

The electrical layout should be considered early enough to coordinate sockets, switches, lighting and other services with the proposed room arrangement, insulation and new wall construction.

Windows & Doors

Replacing the garage door with a new wall and window is one of the most visible parts of a typical garage conversion. In addition to its appearance, the new construction needs to satisfy the relevant requirements for thermal performance, ventilation and safety.

New windows and glazed doors may need to provide appropriate thermal performance and safety glazing, while their size, position and opening arrangement should be considered in relation to ventilation and, where applicable, means of escape.

The junctions around new windows and doors should also be detailed carefully to maintain continuity of insulation, damp protection and weather resistance and to reduce the risk of thermal bridging.

Where the garage conversion changes the external appearance of the property, the proposed window, brickwork and other materials should also be considered in the context of the existing elevation and any applicable planning requirements.

What Drawings Are Needed for a Garage Conversion?

The drawings required for a garage conversion depend on the scope of the work and whether planning permission is required. A simple planning drawing set and a Building Regulations drawing package serve different purposes and should not be confused.

Where planning permission is required, the drawings will normally illustrate the existing and proposed appearance and layout of the property. These may include floor plans, elevations, site information and other drawings necessary to explain the proposed development to the local planning authority.

Building Regulations drawings go considerably further. They explain how the conversion is intended to be constructed and demonstrate how the relevant technical requirements have been addressed.

Typical Building Regulations Drawing Package

For a garage conversion, the Building Regulations drawing package may include existing and proposed floor plans, elevations, sections through the proposed construction and detailed construction notes or specifications.

Depending on the project, the drawings may show matters such as:

  • proposed wall, floor and roof build-ups;

  • insulation and thermal-performance requirements;

  • damp-proofing arrangements;

  • new foundations and garage-door infill construction;

  • structural openings, beams and lintels;

  • ventilation provisions;

  • fire-safety and escape provisions;
